Story 1:Mameng now witness on kidnapping incident on ABS-CBN news team and professor

The guide of ABS-CBN News Team and the professor who went in Jolo, Sulu last June 8 is now considered as witness for the complaint against the father and son Isnaji who are now suspects for the kidnapping incident.

Juamil “Mameng” Biyaw is now at the custody of the PNP Criminal Investigation and Detection Group (CIDG) as he is now being considered as a witness. CIDG Director Chief Supt. Raul Castaneda said that on Biyaw statement he said that he has personal knowledge on the involvement of the Mayor Alvarez Isnaji on the kidnapping of Ces Drilon, Jimmy Encarnacion, Angelo Valderama and Professor Octavio Dnampo.

Biyaw guided the news team and the professor on the destination that they will go to in Barangay Ajid, Indanan, Sulu. Biyaw also said that Dinampo contacted him for a possible interview with Abu Sayyaf Leader leader Radullon Sajiron because he has contact on the said person.

“What I know is that the Mayor has involvement on the kidnapping because when we arrived at the area and was approached by the armed men who were waiting for our arrival, one of them told me that I should leave the area because Mayor Isnaji will take charge and I will be out of the ‘program’,” Biyaw told the reporters.

On what is the meaning of the program that was mentioned to him he said he did not know whether it is the kidnapping incident but he was sure he heard the name of Isnaji. However, Biyaw did not divulge any other information and said that he might be contempt of court but assures that whatever he knew, he will say it on the Court.

Biyaw said that he left the place because he has a fever at that moment and really wanted to rest.
During the preliminary investigation in the CIDG in Camp Crame, both parties, complainants, victims and the suspects view the video that Encarnacion has recorded when they were still in captivity. Encarnacion shot some stolen shot during their abduction and will be used as evidence against other kidnappers that are still at large.

Meanwhile, kidnap victims, Drilon, Encarnacion, and Valderama already filed their supplemental complaint against Isnaji.

According to Sr. Supt. Joel Coronel of the CIDG on the supplemental of the victims they did not directly link the Isnaji, “Though on the statement of Drilon, she said that she has her doubts on mayor Isnaji because during their captivity she sense that Isnaji is not negotiating for their release but for the ransom money.”

PNP Director General Avelino Razon admitted that the PNP is the one who really file the case at the DOJ, “We are the one who pursue the case, whatever supplemental that the victims may add will be helpful for the case.”

Razon also added, “They (Drilon, et al.) cannot positively pinpoint the Isnaji because they were confine in an area during their captivity, they could only relate on what they know on the situation where they were.”

The next hearing on the preliminary investigation is set on July 7, wherein they are expecting Sulu Vice-Governor Lady-An Sahidulla to appear at the hearing and to give information on what she know about the incident or the possibly involvement of the Isnaji.

the danger of the endosulfan

Miami
June 27, 2008
Story 3: the danger of the endosulfan

The pesticide that was inside the MV princess of the Stars was identified as endosulfan after the Del Monte wrote the Fertilizer Pesticide Authority to inform the latter.

The pesticide is in a form of powder flakes and should be diluted to the water and put it in a soil where the pineapple will be planted. The endorsable is being used as pesticides against mites that can damage in pineapple.

The said pesticide is considered as restricted and highly toxic which can cause death to people if ingested, according to experts.

In the press briefing, the NDCC invited Dr. Lynn Panganiban of University of the Philippines National Poison Management Control Center explained the possible effects of endosulfan if ingested by people.

At toxic levels and following ingestion it can cause death or affect the central nervous system, manifesting as headaches, dizziness, nausea, tremors, convulsions which may also include cardiovascular symptoms. blood from exposed individuals can be tested to detect presence of the poison.

The Dept. of Health has announced that the endosulfan has not yet contaminated the water in the area where the vessel capsized because there were no fish kills yet or any divers that got sick. But the divers will be under medical check-up to check if the pesticide already affected them. Also because the endosulfan cannot be easily diluted in the water but it will attached to the soil.

If the endosulfan be diluted into water in time, and will easily spread on the soil or even at the sea bed the marine life will be affected. “That is why we really need to move now on how we can remove the pesticide inside the ship for long term solution.,” Panganiban added.

However, if the endosulfan was released in the environment, endosulfan enters the air, water and soil, it does not dissolve easily in water. Most of the chemical in surface water is attached to soil particles floating in the water or attached to soil at the bottom, the small amount of endosulfan that dissolve in water breakdown over time. depending on theconditions in the water.

Endosulfan may breakdown within one day or may take several months. Some endosulfan in surface water evaporates into air and breaks down. Animals like fishes that live in endosulfan contaminated waters can build up endosulfan in their bodies. The amount of endosulfan in their bodies can be several times greater that in the surrounding water.

Panganiban said, “Endosulfan carries a lethal dosage of .8 to 8 milligrams per kilogram of weight for humans, saying that a small tablet of Endosulfan powder is enough to kill a person. This means, if you weigh 20 kilos, that’s times (multiply) 8 milligrams. You will die if you ingested 400 milligrams of the chemical. That’s how toxic it is.”

She also added that there are no specific antidotes to if a person being poisoned by endosulfan. What Panganiban said only preventive measures can be done so that the endosulfan will not enter ones body or to prevent the poison on spreading at the body.

Vice Noli De Castro added that 94% of endosulfan is present at the vessel.

Search and retrieval operations on the capsized ferry suspended due to pesticide inside

Story 1: Search and retrieval operations on the capsized ferry suspended due to pesticide inside

The National Disaster Coordinating Council (NDCC) has announced the suspension of search and retrieval operations on the capsized passenger vessel in Sibuyan Island after the authorities received information that tons of pesticide were inside the ferry.

Vice-President Noli de Castro together with the NDCC, Department of Health (DOH) and Department of Transportation and Communication (DOTC) held an emergency meeting early morning of Friday because of the situation.

“On this day, we decided to abort the search and retrieval operations because of the problem on the pesticide inside the ship which can also affect our divers,” De Castro said in a press conference.

The MV Princess of the Stars is carrying a 10 metric tons or 10,000 kilos of endosulfan. As explained by Bautista, the chemical was put in a box inside 40-foot container. “The box is being covered by a plastic but it was not sealed and was only tied with a wire at the top of it,” she said.

The pesticide that was inside the ferry is an endosulfan a kind of pesticide used for pineapple against mites and it was considered as highly toxic chemical.

According to DOTC Undersecretary Elena Bautista their office received a letter addressed to DOTC Sec Leandro Mendoza from Fertilizer Pesticide Authority (FPA) stating that on June 24, they received a letter from Del Monte Philippines that the MV Princess is carrying the said pesticide. Del Monte said that the pesticides belongs to them.

The said letter from FPA received by the DOTC Thursday afternoon. According to Bautista the FPA gave them two copy of letters from del Monet informing the FPA that the MV Princess is carrying their pesticide and another letter of Del Monte to Sulpicio Lines declaring that there is a toxic substance on their cargo and to take precautionary measures for the environment and for the passengers.

“Obviously, the Sulpicio Lines did not informed the government that there is a pesticide inside the capsized ship, with this information we will make sure that the company will be held liable for this,” De Castro said.

The said pesticides will be brought to Cebu, then from Cebu it was supposed to be brought to Cagayan de Oro where the Del Monte has pineapple plantation.

On the said pres conference, the Philippine Coast Guard will also be under investigation whether they really do not know that there is a pesticide inside the passenger vessel.

“We are checking on that, the ship should get authority or permission from PCG and to declare that they will be carrying hazardous material,” Bautista said.

She also said that it is prohibited for a passenger vessel to carry a hazardous chemical, so if there was no certification from PCG, the Sulpicio Lines did not follow rules and regulations. “It is very that they violated some rules, and what we are confirming now is that the chemical was placed on the same area were the vegetables was placed,” De Castro said.

The said pesticide is not ban in the country but was being categorized as restricted and only those with pineapple industry can have it. Executive Director of the FPA Dr. Norlito explained that only Del Monte and Dole are the only company who can import it in the Philippines.

The endosulfan is being used as pesticide for pineapples against mites, being diluted in a water and to be put directly on the soil.

The pesticide was said to be placed on the other end of the ship, that was being submerged in the water.

About 100 divers that were exposed on the water will be under medical check-up to know if they were being contaminated already also to study on how they can get the pesticide out of the ship.

On Saturday, June 28, some divers with protective gears and expertise on the chemicals will dive at the area to get water samples to check if the endosulfan already diluted in the water. Though they are saying that the endosulfan does not easily dissolve on water.

Arevalo explained that in the process of getting the bodies on the water. He said the ship will unload their rubber boats then the divers will get the bodies at the water then load it on the ship mentioned.

“This process take times, more than an hour, that is why many people think we are slow in our work here,” Arevalo said.

AFP on track for the 2010 deadline on eradicating the insurgencies

Story 3: AFP on track for the 2010 deadline on eradicating the insurgencies

The Armed Forces of the Philippines claim that they are on track on the 2010 deadline given by President Gloria Macapagal-Arroyo to eradicate the insurgencies in the country.

The CPP-NPA-NDF still considers to be the major national threat in the country because “This group has threat to overthrow this government and for them to make their own,” AFP Chief of Staff Alexander Yano said in the media forum with the members of Foreign Correspondents Association of the Philippines (FOCAP). Yano added that the NPA still have 5,600 active members.

AFP Deputy Chief of Staff for Operations Maj. Gen. Romeo Lustestica confirm that they are on track on their 2010 deadline to defeat the insurgency groups because they have brought them down to an inconsequential level, “We are confident that we will be able to get our target. When we say we are defeating insurgency, it means that we have brought them down to an inconsequential level, that means we have destroyed their forces at least 70 percent so that is what we mean when we say that we are able to defeat insurgency.”

Though Yano had admitted that they cannot reduce it into zero. “There will always be recalcitrance in any society just like a small family,” Yano said.

He added what he mean by inconsequential level is that the group can no longer have the capability to affect governance and the police can addressed the situation because it will be only considered as plain law enforcement.

On the Abu Sayyaf members, Yano believed that they are already reduced to 360 members and they look at them as a loose organization with no leader to follow and to look into. “Some of them may have been codnucting their own operations and now has degenerated into a money making group or activity devoid of any semblance of ideology or cause, they have degenerated into plain bandits and i feel that the leadership vacuum that is being experience now would be one of the main reasons why they have to generate both the leadership vacuum and fund income or fund shortages could have forced them to engage in this money making schemes,” Yano explained.

He also said operations is ongoing on the area where the news team of ABS-CBN was kidnapped.

Villanueva explained, cutting the ship or creating a whole may cause for the ship to sink because air might enter on the whole that they will be making. “Air pressure will not be helpful for us, also the divers might drowned as well,” Villanueva said.

The other thing that they are considering why they do not want to cut the hull of the ship is because they might hit the tanker of the ship and will cause more damage on the area.

Meanwhile, according to Vice President of Sulpico Lines Mr. Ed Go and VP for Passenger service, representatives from Sulpicio Lines who attended the press briefing said that they will shoulder the expenses of the victims as well both the living and the dead.

For the death families, Php200,000 will be allotted for each of them and can be claim by the immediate family. But they have to undergo a process to prove that they are really the immediate family. The Department of Social Welfare and Development will assit the victims on processing it.

For the survivors, Sulpicio Lines will shoulder the medications, hospitalization and even their fare trip on going to Cebu City or Manila.

NDCC Executive Director Anthony Golez said that the body of the victims will be brought to Cebu City since most of them are natives of Cebu. The bodies will be brought in Cebu city for proper identification of the body. The NBI will be the one who will do the identification of the body.

PNP is the only complainant here, Isnajis lawyer said

Story: PNP is the only complainant here, Isnajis lawyer said

The lawyer of the kidnapping suspect on the news team of the ABS-CBN has withdrawn his appearance and prefer a Muslim lawyer to take charge after him.
Atty. Ernesto Francisco who is the lawyer of Indanan, Sulu Mayor Alvarez Isnaji and Haider Isnaji during the inquest proceedings last June 20, 2008 has withdrawn his appearance and said somebody who know Mindanao should be the one who will handle the case.

“I ask the Isnaji to get a lawyer that totally know the situation in Mindanao. My withdrawal has nothing to do with the merits of the case. I still think the evidence against them is not strong enough to consider them as suspects,” Atty. Francisco said.

Francisco explained the reason why he stand as counsel for the two during the inquest is that somebody ask his help because the two has no lawyer yet and the inquest proceedings will happen on that day of Friday June 20.

The one who replace Francisco is Atty. Firdausi Abbas. He is the one who said the PNP is the only complainant on the case against the Isnajis. The complaint affidavit is filed by Senior Superintendent Winnie Quidato from the PNP intelligence group who joined in the negotiating team by disguising a civilian official from the Department of Local and interior Government (DILG).

“The victims (Ces Orena Drilon, Jimmy Encarnacion and Angelo Valderama) affidavit do not contain any direct complaint against the suspects. In their affidavit it only said that their affidavit ‘may use for any legal purposes that may serve’. Unlike in the affidavit of Quidato, it stated their that his affidavit can be used as basis for the criminal charge against the suspects,” Abbas explained.

That was backed up by State Prosecutor Emily delos Santos. She even asked the lawyers of Drilon, et al. if they will file a supplemental or amended complaint to support the complaint of Quidato. They were given five days to do it. If they will file it, the next hearing will be on June 30 at 2:00 pm. But, if the lawyers of Drilon, et al will not file a supplement or amended complaint the next hearing will be on July 7.

“At this moment we do not intend to comply supplemental or amendment complaint,” Atty. Vince Bayon said during the preliminary investigation, lawyer of Drilon, Valderama and Encanacion.

Meanwhile, Prosecutor delos Santos had Subpoena the notes and documents of Philippine Star writer Tanya Lara who had interviewed Drilon on her experience with the abductors. The feature story on it was published in the Lifestyle section of Philippine Star last June 22, 2008.

After the preliminary investigation, Mayor Isnaji said, “I cannot understand why I am here, facing the charges were in fact we only helped the four to be released on their abductors.”

His son added, “What is important is that the four are safe, it is just hard to believe that we are here.”

Abbas, the lawyer of the Isnaji confirmed that there were another ransom money was paid for the release of the other three, Drilon, Encarnacion and Prof. Octavio Dinampo. “Php15M was paid for their release by still anonymous person and this is written in the affidavit of Quidato.”

Abbas added that the money was brought to Zamboanga then to Jolo by Frank Orena, the brother of Ces, the same person who delivered the Php5M when Valderama was released.

Abbas also said that it is impossible for his clients to be the suspects because during the captivity of the four, Drilon talked to Mayor Isnaji and asked him not to backed out on the negotiations. “Isnaji is talking to the kidnappers because he was the one that was chosen by the kidnapers to be their negotiators. The kidnappers is the one insisting for Isnaji to be their negotiators, it doe not mean he is the master mind.”

Story 1: Mayor Isnaji partake on the paid ransom money, officials said

The mayor who stand as negotiator for the release of the ABS-CBN News team kidnap victims kept almost half of the paid ransom money, police officials said.

Indanan, Sulu Mayor Alvarez Isnaji and his son Haider Isnaji now faces charges of four counts of kidnap for ransom after the inquest proceedings done late night of Thursday. The inquest proceedings was finished at around 1:00 am of Friday, June 20.

Philippine National Police Chief Avelino Razon said they have evidences that will show that the father-and-son Isnaji are suspects on the kidnapping of Ces Drilon, her two TV crew Jimmy Encarnacion, Angelo Valderama and Mindanao State University Professor Octavio Dinampo.

“The Criminal Investigation an Detection Group (CIDG) is holding many evidences that will show that they are involved on this incident. We have witnesses accounts, intelligence reports, statements, pictures and records of events that will show that,” the PNP Chief told the media in a press conference.

Razon showed two pictures that will show the involvement of the Isnajis on partaking on the ransom money. Razon said they later learned that in the afternoon of June 12, 2008 the brother of Ces named Frank went to Jolo to deliver Php5-M as ransom money. Somebody else has brought the money to the house of the Mayor. But the kidnappers released Angelo Valderama at around 9:45 pm instead of Ces. Razon said Php2M was paid to the abductors and the Php3M was kept by Mayor Isnaji. Though it is not yet clear where the money came from if it is from the family of Ces itself or from the ABS-CBN.

Razon learned of the involvement of the two Isnaji after Senior Superintendent Winnie Quidato from PNP intelligence group acted as civilian employee of Department of Interior and Local Government (DILG) learned the works of the two Isnaji. Quidato volunteered himself to mayor Isnaji to be part of the negotiation team. No one doubt of his reasons on joining the negotiation team because there are other people who are volunteering themselves to Isnaji.

The PNP sent Quidato on the place to be undercover agent after they learned that the leader of the kidnap for ransom group that abducted Drilon and others has an alias of Larin-larin. During the stay of Quidato on the area they also learned that Larin-larin is the alias of mayor Isnaji itself.
“This information came from local sources not only from one source. Fishing together the information that was given, Larin-Larin is the alias of Mayor Alvarez Isnaji,” Razon said.

However, Ranzon admitted that they did not know how did Mayor Isnaji paid the ransom money to the kidnappers, “What we are looking now is if he is really the leader of the kidnap for ransom group while he is the current Mayor of Indanan.”

The CIDG already filed kidnap for ransom case against Mayor Isnaji, Haider Isnaji, Abu Harris alias Tek, alias Taun Wals or Walid; alias James and 13 other John Does before the DOJ. The preliminary investigation was set on June 23, 2008 at 1:30 pm.

Meanwhile, Sulu Vice-Gov. Nur-ana “Lady Ann” Saidula who was included in the picture will not be charged of kidnapping. Razon explains that this is because Saidula is the negotiator of the government side and can shed light on what really happened on the negotiations and on how the Isnaji negotiated for the kidnappers.

“It is a separate incident and it is part of the ongoing operation against the terrorist Abu Sayyaf group, it has been planned earlier and we are just pursuing that operation,” Torres said adding that it just so happened that the ABS-CBN reporter Ces Drilon and her crew were being hostage by the kidnappers on the said place.

“We would like to make it clear that the mortar shelling that was conducted by the military in Sulu last Sunday is not a part of the ongoing efforts to locate and secure Ms. Ces Drilon and her group,“ Torres said.

The shelling happened in Indanan, Sulu and in Talipao, Sulu, but the AFP is confident that the group of Ces Drilon is not at the area anymore, “They transfer in one place to another, that is why we are very sure that the place we bombard is the place of other ASG members,” Torres said.

He also clear that the shelling is not to make any rescue operations, “As of now there is no military operation being directed for the purpose of rescuing them so what we are doing now is trying to locate and continuously give our assessment to the crisis management committee but we would like to say that your military is always ready to react or to conduct any military operation when needed, when necessary,” Torres added.

Torres said that the military is being represented in the crisis management committee headed by Sulu Governor Sakur Tan but they are not involved in any actions that the negotiating team is doing. “They are on top of the situation. This situation cannot be solved by the military alone, or by the Philippine National Police alone so there is a collective effort in addressing this problem, he said.
