The Quezon City judge has suspend its ruling for the motion to exclude former Basilan Representative Gerry Salapuddin. Since the issue must be resolved first by the Court.

Judge Ralph Lee of Quezon City Regional Trial Court (QCRTC) Branch 83 said that he will release the resolution within 30 days on whether Salapuddin will be excluded or not within 30 days.

The Department of Justice has Department of Justice ruled that Salapuddin must be excluded from the charges, saying there is no probable cause that he participated in the planning and execution of the Batasan bombing last November 2007.

Assistant Prosecutor Maryjane Sytat moved for Salapuddin's exclusion on the charges as directed by DOJ secretary Raul Gonzales. Sytat filed the said motion last April 30, 2008.

Atty. Jovertino Diamente, counsel of Salapuddin said that he is asking to reduced it for 15 days, “The Court can ruled on it already, it is the DOJ who already filed for the exclusion of my client because they did not see any evidence that will link him to the bombing.”

But Judge Lee said the maximum days for him is 30 days so why not used it.

With the pending resolution on Salapuddin’s motion Sytat has asked the judge if they can already proceed with the pre-trial which was set on July 11, 2008. The prosecution is expected to present their evidences for marking.
The suspects in jail now are Adham Kusain, Caidar Aural both detained in Camp Bagong Diwa and Ikraim Indama detained in Camp Crame under the custody of CIDG.

There are still others who are still at-large, they are Hajarum Jamiri, Benjamin Hataman and PO1 Bayan Judda.
